AmericanCrypto Terms of Service

These Terms of Service (the "Terms") govern your access to and use of americancrypto.net and any related products and services provided by AmericanCrypto, including any websites, applications, dashboards, documentation, APIs, datasets, data feeds, and other features or content (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Services.
1. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.
2. Accounts and Security
You may need to create an account to access certain Services, including paid plans. You agree to provide accurate information and to keep your account information up to date. You are responsible for maintaining the confidentiality of your credentials (including API keys) and for all activity occurring under your account. You must notify us promptly if you suspect unauthorized access or misuse.
3. Subscriptions, Billing, and Price Changes
3.1 Subscription Plans
Certain features of the Services require a paid subscription ("Subscription"). Subscriptions are generally billed on a monthly recurring basis unless stated otherwise at the time of purchase.
3.2 Billing Authorization
By starting a Subscription, you authorize AmericanCrypto and its payment processors to charge your payment method on a recurring basis until your Subscription is canceled.
3.3 No Refunds
All fees are non-refundable to the fullest extent permitted by law. AmericanCrypto does not provide refunds or credits for partial billing periods, unused usage, downgrades, or early termination.
3.4 Price Changes
We may change pricing for Subscriptions and other fees from time to time, including for renewals. Price changes will apply going forward, typically beginning with a future billing cycle. If you do not agree to a price change, your remedy is to cancel your Subscription prior to the effective date of the change.
4. License and Permitted Use
4.1 License Grant
Subject to these Terms and your compliance with them, AmericanCrypto grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your internal business purposes and/or personal use, depending on your plan.
4.2 Attribution Requirement
If you display, publish, or present data from the Services publicly (including in an application, website, dashboard, report, article, or other user interface), you must provide reasonable attribution indicating that the data is sourced from AmericanCrypto (for example: "Data provided by AmericanCrypto" with a link where feasible).
4.3 No Resale / No Data Brokerage
You may use the Services and data for your own purposes, but you may not:
- sell, resell, license, sublicense, rent, lease, distribute, or otherwise commercially exploit the Services or data as a standalone product;
- offer the data as a competing dataset/API/feed;
- provide "white-label" access or make the data available to third parties as a primary value of your product or service;
- create or sell derivative datasets that are substantially similar to, or a substitute for, the Services.
4.4 No Passing Off
You may not represent the data, labels, classifications, or outputs as your own proprietary dataset or imply that AmericanCrypto is not the source where attribution is required.
5. Acceptable Use; Abuse; Rate Limits and Throttling
You agree not to use the Services in any manner that is unlawful, harmful, or interferes with the operation of the Services.
Without limiting the foregoing, you may not:
- attempt to circumvent any access controls, authentication, or security measures;
- scrape, probe, scan, or test the vulnerability of the Services;
- use bots or automated means to access the Services in a way that materially burdens the infrastructure beyond intended use;
- share, transfer, or publicly post API keys or account credentials;
- reverse engineer or attempt to extract underlying source code, models, or non-public methodologies except to the extent such restrictions are prohibited by law.
5.1 Rate Limits; Temporary Adjustments
The Services may include rate limits, quotas, or other usage controls. AmericanCrypto may throttle, suspend, or restrict your access to protect system integrity, prevent abuse, or maintain service quality. We may also temporarily adjust limits/quotas (up or down) based on system conditions, security concerns, technical constraints, or business requirements.
6. Data and Service Characteristics; No Reliance
The Services provide blockchain-related information, analytics, labels, classifications, and/or derived outputs that may be probabilistic, interpretive, incomplete, delayed, or subject to reorgs and other chain conditions. You acknowledge that data may originate from third parties and may contain errors.
You agree that you are solely responsible for verifying any information you obtain from the Services and for your use of the Services.
7. Intellectual Property
The Services (including software, APIs, documentation, dashboards, datasets, methodologies, classifications, labels, scoring systems, trademarks, logos, and all other content) are owned by AmericanCrypto or its licensors and are protected by intellectual property laws.
Except for the limited license granted in these Terms, nothing in these Terms transfers any right, title, or interest in the Services to you.
8. Suspension and Termination
AmericanCrypto may suspend or terminate your access to the Services (in whole or in part) at any time, with or without notice, for any reason or no reason, including if we believe you have violated these Terms or engaged in abusive behavior.
Upon termination, your right to use the Services ends immediately. Sections that by their nature should survive termination will survive, including but not limited to Intellectual Property, Disclaimers, Limitation of Liability, and Governing Law.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, AMERICANCRYPTO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, AVAILABILITY, OR ERROR-FREE OPERATION.
Some information may be sourced from third parties, and AmericanCrypto does not guarantee accuracy, completeness, or timeliness. Blockchain data can be probabilistic/subject to reorgs and interpretation; labels and classifications are best-effort.
Nothing on the Services constitutes financial, investment, legal, or tax advice, and nothing is intended as a recommendation, solicitation, or offer to buy or sell any asset or engage in any trading strategy. Any use of the Services is at your own risk. You should conduct your own research and consult a qualified professional before making financial decisions. Trading and investing involve significant risk and may result in substantial losses.
10. Limitation of Liability
To the maximum extent permitted by law:
- AmericanCrypto will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to your use of the Services.
- AmericanCrypto's total liability for any claim arising out of or related to the Services will not exceed the amounts you paid to AmericanCrypto for the Services in the one (1) month preceding the event giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless AmericanCrypto and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.
12. Changes to the Services and Terms
We may modify, suspend, or discontinue the Services (in whole or in part) at any time. We may also update these Terms from time to time. The "Last Updated" date indicates when these Terms were last revised. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
13. Privacy Notice and Cookies
This Privacy Notice describes how AmericanCrypto collects, uses, discloses, and protects personal information when you visit or use the Services. It is part of these Terms, but agreeing to the Terms is not treated as consent where applicable law requires a separate affirmative choice.
13.1 Information We Collect
We may collect information you provide, including your name, email address, organization, account credentials, subscription and plan information, support requests, and contact-form submissions. We also process service and security information such as API usage, request timestamps, IP address, browser or device details, and records needed to authenticate accounts, enforce quotas, investigate abuse, and keep the Services reliable.
13.2 How We Use Information
We use personal information to provide and secure the Services; create and administer accounts; process subscriptions; issue and manage API keys; measure usage; enforce limits; prevent fraud and abuse; respond to inquiries; maintain and improve the Services; communicate service-related notices; and comply with legal obligations.
13.3 Service Providers and Disclosures
We may disclose information to vendors that process it on our behalf, including Vercel for website hosting and analytics, Stripe for checkout and subscription billing, Resend for email delivery, and infrastructure or security providers needed to operate the Services. Stripe handles payment-card information directly; AmericanCrypto does not store complete payment-card numbers. We may also disclose information when required by law, to protect rights or security, or in connection with a business transaction. We do not sell personal information or use it for cross-site targeted advertising.
13.4 Cookies and Analytics
We use essential cookies for account authentication, secure sessions, checkout flows, and abuse prevention. These cookies are necessary for requested features to function and are not used for advertising. We also use Vercel Web Analytics to understand aggregated website traffic. Vercel Web Analytics does not use cookies and is not intended to identify visitors across websites or across different days.
13.5 Retention and Security
We retain information for as long as reasonably necessary to provide accounts and subscriptions, meet contractual and legal requirements, resolve disputes, prevent abuse, and protect the Services. Retention periods vary by the type and purpose of the information. We use reasonable administrative, technical, and organizational safeguards, but no method of transmission or storage is completely secure.
13.6 Your Privacy Choices
Depending on where you live and subject to applicable exceptions, you may have rights to request access to, correction of, deletion of, or a portable copy of your personal information, and to appeal a decision concerning such a request. 13.7 Changes to This Notice
We may update this Privacy Notice as our practices or legal obligations change. We will update the “Last Updated” date above and provide additional notice when a material change requires it.
14. Governing Law; Disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law rules. You agree that any dispute arising out of or related to these Terms or the Services will be brought in the state or federal courts located in New Jersey, and you consent to personal jurisdiction and venue in those courts.
